Terms of Service

This privacy policy informs you about the type, scope, and purpose of processing personal data (hereinafter referred to as “data”) in the context of providing our services as well as within our online offerings, the associated websites, features, and content, and external online presences, such as our social media profiles (hereinafter collectively referred to as the “online offering”). For the definitions of terms such as “processing” or “controller,” we refer to the definitions in Article 4 of the General Data Protection Regulation (GDPR).

Used Terminology

“Personal data” means any information relating to an identified or identifiable natural person (hereinafter referred to as the "data subject"); an identifiable natural person is one who can be identified, directly or indirectly, particularly by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g., cookie), or one or more specific characteristics that express the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

“Processing” means any operation or set of operations which is performed on personal data, whether or not by automated means. The term is broad and encompasses practically any handling of data.

“Pseudonymization” means the processing of personal data in such a way that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

“Profiling” means any kind of automated processing of personal data, which involves using that personal data to evaluate certain personal aspects relating to a natural person, particularly to analyze or predict aspects concerning work performance, economic situation, health, personal preferences, interests, reliability, behavior, location, or movements of that natural person.

“Controller” means the natural or legal person, authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

“Processor” means a natural or legal person, authority, agency, or other body which processes personal data on behalf of the controller.

Applicable Legal Grounds

In accordance with Article 13 of the GDPR, we inform you of the legal grounds for our data processing activities. For users within the scope of the General Data Protection Regulation (GDPR), i.e., the EU and the EEA, the following applies unless the legal basis is otherwise mentioned in the privacy policy:
The legal basis for obtaining consent is Article 6(1)(a) and Article 7 of the GDPR;
The legal basis for processing for the performance of our services and carrying out contractual measures as well as responding to inquiries is Article 6(1)(b) of the GDPR;
The legal basis for processing to fulfill our legal obligations is Article 6(1)(c) of the GDPR;
In the event that the processing of personal data is necessary to protect vital interests of the data subject or another natural person, Article 6(1)(d) of the GDPR serves as the legal basis.
The legal basis for necessary processing for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller is Article 6(1)(e) of the GDPR.
The legal basis for processing to safeguard our legitimate interests is Article 6(1)(f) of the GDPR.
The processing of data for purposes other than those for which they were collected is determined by the provisions of Article 6(4) of the GDPR.
The processing of special categories of data (according to Article 9(1) of the GDPR) is governed by the provisions of Article 9(2) of the GDPR.

Security measures

We take appropriate technical and organizational measures in accordance with the legal requirements, taking into account the state of the art, the implementation costs and the nature, scope, circumstances and purposes of the processing as well as the different likelihood and severity of the risk to the rights and freedoms of natural persons, in order to ensure a level of protection appropriate to the risk. The measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical access to the data, as well as the access, input, disclosure, safeguarding of availability and separation of the data. Furthermore, we have established procedures that ensure the exercise of data subject rights, the deletion of data and the response to data threats. Furthermore, we take the protection of personal data into account as early as the development and selection of hardware, software and processes, in accordance with the principle of data protection through technology design and data protection-friendly default settings.

Cooperation with processors, joint controllers and third parties

If we disclose data to other persons and companies (processors, joint controllers or third parties) as part of our processing, transfer it to them or otherwise grant them access to the data, this will only be done on the basis of legal permission (e.g. if the transfer of data to third parties, such as payment service providers, is necessary to fulfill the contract), users have consented, a legal obligation provides for this or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.). If we disclose, transfer or otherwise grant access to data to other companies in our group of companies, this is done in particular for administrative purposes as a legitimate interest and, in addition, on a basis that complies with the legal requirements.

Subject to express consent or contractually required transfer, we only process or have the data processed in third countries with a recognized level of data protection, including US processors certified under the “Privacy Shield” or on the basis of special guarantees, such as contractual obligations through so-called standard protection clauses of the EU Commission, the existence of certifications or binding internal data protection regulations (Art. 44 to 49 GDPR, information page of the EU Commission).

Rights of the data subjects

You have the right to request confirmation as to whether the data in question is being processed and to request information about this data as well as further information and a copy of the data in accordance with the legal requirements. You have the right to request the completion of data concerning you or the correction of incorrect data concerning you in accordance with the legal requirements. In accordance with the legal requirements, you have the right to demand that the data in question be deleted immediately or, alternatively, to demand that the processing of the data be restricted in accordance with the legal requirements. You have the right to request that the data concerning you that you have provided to us be received in accordance with the legal requirements and to request that it be transferred to other data controllers. You also have the right to lodge a complaint with the competent supervisory authority in accordance with the statutory provisions.

Right of withdrawal

You have the right to withdraw your consent with effect for the future.

Right of objection

You can object to the future processing of data concerning you at any time in accordance with the legal requirements. In particular, you may object to processing for direct marketing purposes.

Cookies and right to object to direct advertising

Cookies” are small files that are stored on users' computers. Different information can be stored within the cookies. A cookie is primarily used to store information about a user (or the device on which the cookie is stored) during or after their visit to an online service. Temporary cookies, or “session cookies” or “transient cookies”, are cookies that are deleted after a user leaves an online service and closes their browser. The content of a shopping cart in an online store or a login status, for example, can be stored in such a cookie. Cookies that remain stored even after the browser is closed are referred to as “permanent” or “persistent”. For example, the login status can be saved if the user visits the website after several days. The interests of users can also be stored in such a cookie and used for reach measurement or marketing purposes. “Third-party cookies” are cookies that are offered by providers other than the controller who operates the online service (otherwise, if they are only the controller's cookies, they are referred to as ‘first-party cookies’).

Otherwise, the personal cookies of the users are processed in accordance with the following explanations in the context of this data protection declaration on the basis of our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f. We ask you to inform yourself regularly about the content of our privacy policy. We will adapt the privacy policy as soon as changes to the data processing carried out by us make this necessary. Contact us

When contacting us (e.g. by contact form, e-mail, telephone or via social media), the user's details will be used to process the contact request and its processing in accordance with Art. 6 para. 1 lit. b. (in the context of contractual/pre-contractual relationships), Art. 6 para. 1 lit. f. (other requests) GDPR. The information provided by users may be stored in a customer relationship management system (“CRM system”) or comparable inquiry organization.

We delete the requests if they are no longer required. We review the necessity every two years; the statutory archiving obligations also apply.

 

Hosting and e-mail delivery

The hosting services we use serve to provide the following services: Infrastructure and platform services, computing capacity, storage space and database services, e-mail dispatch, security services and technical maintenance services that we use for the purpose of operating this online offering.

In doing so, we or our hosting provider process inventory data, contact data, content data, contract data, usage data, meta and communication data of customers, interested parties and visitors to this online offer on the basis of our legitimate interests in an efficient and secure provision of this online offer in accordance with Art. 6 para. 1 lit. f GDPR in conjunction with Art. 28 GDPR (conclusion of contract). Collection of access data and log files

We, or our hosting provider, collect data on the basis of our legitimate interests within the meaning of Art. 6 para. 1 lit. f. GDPR. GDPR, we collect data about every access to the server on which this service is located (so-called server log files). The access data includes the name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page), IP address and the requesting provider.

Log file information is stored for security reasons (e.g. to investigate misuse or fraud) for a maximum of 7 days and then deleted. Data whose further storage is required for evidence purposes is excluded from deletion until the respective incident has been finally clarified.

 

Google Analytics

We use Google Analytics, a web analysis service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). Google uses cookies. The information generated by the cookie about users' use of the online offering is usually transmitted to a Google server in the USA and stored there.

Google will use this information on our behalf to evaluate the use of our online offering by users, to compile reports on activities within this online offering, and to provide us with further services related to the use of this online offering and internet usage. Pseudonymous user profiles may be created from the processed data.

We use Google Analytics only with IP anonymization activated. This means that the IP address of users is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there.

The IP address transmitted by the user’s browser will not be merged with other data held by Google. Users can prevent the storage of cookies by selecting the appropriate settings in their browser software. Additionally, users can prevent Google from collecting and processing data generated by the cookie related to their use of the online offering by downloading and installing the browser plugin available at: http://tools.google.com/dlpage/gaoptout?hl=en.

Otherwise, the personal data of users is processed based on our legitimate interests (i.e., interest in analyzing, optimizing, and economically operating our online offering as per Article 6(1)(f) GDPR).

The personal data of users will be deleted or anonymized after 14 months.

 

Google AdWords and Conversion Tracking

We use the services of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”).

Google is certified under the Privacy Shield framework, thereby providing a guarantee of compliance with European data protection laws (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

We use the online marketing tool Google "AdWords" to place ads in the Google advertising network (e.g., in search results, videos, on websites, etc.) so that they are shown to users who are presumed to have an interest in the ads. This allows us to display ads more specifically for and within our online offering, presenting users only with ads that potentially match their interests. For example, if a user is shown ads for products they were interested in on other online offerings, this is referred to as “remarketing.” For these purposes, when users access our or other websites where the Google advertising network is active, a Google code is directly executed by Google, and so-called (re)marketing tags (invisible graphics or code, also referred to as “web beacons”) are embedded in the website. These tags help store a unique cookie, i.e., a small file, on the user’s device (similar technologies may also be used instead of cookies). This file records which websites the user visits, the content they are interested in, the offers they clicked on, as well as technical information about the browser and operating system, referring websites, visit time, and further details on the use of the online offering.

We also receive an individual "conversion cookie." The information collected via this cookie is used by Google to create conversion statistics for us. However, we only receive anonymous aggregated data, such as the total number of users who clicked on our ad and were redirected to a page tagged with conversion tracking. We do not receive any information that could personally identify users.

Within the Google advertising network, user data is processed pseudonymously. This means that Google does not store or process names or email addresses but rather processes the relevant data associated with the cookie in pseudonymous user profiles. From Google’s perspective, the ads are not managed or displayed for a specifically identifiable person but for the cookie holder, regardless of who the cookie holder is. This does not apply if a user explicitly allows Google to process the data without this pseudonymization. The information collected about users is transmitted to Google and stored on Google’s servers in the USA.

Facebook Pixel, Custom Audiences, and Facebook Conversion

Within our online offering, the so-called "Facebook Pixel" of the social network Facebook, operated by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"), is used.

With the help of the Facebook Pixel, Facebook is able to determine the visitors of our online offering as a target group for the presentation of advertisements (so-called "Facebook Ads"). Accordingly, we use the Facebook Pixel to display the Facebook Ads we place only to Facebook users who have shown an interest in our online offering or who exhibit certain characteristics (e.g., interests in specific topics or products identified based on the websites visited) that we transmit to Facebook (so-called "Custom Audiences"). Online Presences in Social Media

We maintain online presences within social networks and platforms to communicate with customers, prospects, and users active there and to inform them about our services.

We point out that user data may be processed outside the European Union. This may pose risks for users, such as making it more difficult to enforce their rights. Regarding US providers certified under the Privacy Shield framework, we note that they commit to adhering to EU data protection standards.

Additionally, user data is typically processed for market research and advertising purposes. For instance, user profiles may be created from user behavior and interests, which can then be used to display ads inside and outside the platforms that are presumed to align with user interests. For these purposes, cookies are generally stored on users' devices to record their usage behavior and interests. Furthermore, user profiles may also include data independent of the devices used by users (especially if they are members of the respective platforms and logged in).

The processing of users' personal data is based on our legitimate interests in effectively informing and communicating with users under Article 6(1)(f) GDPR. If platform providers request user consent for data processing as described above, the legal basis for processing is Article 6(1)(a) and Article 7 GDPR.

Integration of Third-Party Services and Content

Within our online offering and based on our legitimate interests (i.e., interest in the analysis, optimization, and economical operation of our online offering as defined by Article 6(1)(f) GDPR), we use content or service offerings from third-party providers to integrate their content and services, such as videos or fonts (hereinafter uniformly referred to as “content”).

This always requires that the third-party providers of this content perceive the IP address of users, as they could not send the content to their browsers without the IP address. The IP address is therefore necessary for displaying this content. We strive to use only content whose respective providers use the IP address solely to deliver the content. Third-party providers may also use so-called pixel tags (invisible graphics, also referred to as "web beacons") for statistical or marketing purposes. Using pixel tags, information such as visitor traffic on the pages of this website can be evaluated. The pseudonymous information may also be stored in cookies on users' devices and include technical information about the browser and operating system, referring websites, visit time, and other details regarding the use of our online offering.
